Midland Credit Management complaint

Have been trying and trying to find out what the heck is going on with this Midland Credit thing and running into a brick wall. They sent me letters and I responded asking for info and never heard back from them. Now I come to find out they have filed suit against us for a debt that has got to be ancient (we forgot about it and thought it was paid) and I am a nervous wreck!!!! I cannot believe this happening just at a time when we are already in financial turmoil and I just simply don't know what to do to get these guys off my back. Anybody have any suggestions????

What you can do is see if they will work with you to do payment plan. At this time you are out of the dispute time frame you only have 45 days to dispute it to ask for that info. Your best bet is to talk to them and see about an arrangement before it is too late.

Write asking for "validation" of the debt (i.e. that they own it, who sold it, when it went delinquent, what amount it was at when it went delinquent, the original creditor's terms when you signed anything, a copy of something showing you signed something, and copies of [all?] prior statements showing payments ever made). If the debt is truly old, it may be outside your state's statute of limitations (commonly 3-5 years starting usually 6 months after it went delinquent). In which case, if you tell them that you know it is outside the SOL, they will know you know and may stop any actions. Right now they are preying on your ignorance.
