Midland threatened me with wage garnishment.

Midland Credit Management complaint
Midland Credit purchased my old debt from Spiegel a few months ago. I made the intial contact with Midland in an effort to establish payment arrangements. Since then they have accepted two payments from me but have also called and harrassed me over the phone with threats of legal action and wage garnishment. I told the rep. that I couldn't pay the $385.00 all at once but would make consistent payments monthly until the balance was paid. That wasn't enough for them, they are sending me threating letters now that I won't answer their rude calls.

Im going through the same thing with these people. They originally told me I had to pay them $250 a month if I wanted to stay out fo court and I told them no. I told them I was sending them $50 a month until my debt was paid. I have been sending them $50 a month and they sure have been cashing my checks, but they still call and harrass me and leave threatening messages on my voicemail.

I am in the same situation except when they call me fifteen times a day, I answer and ask them to please fax me any information they have pertaining to my "debt". The people that work there are very rude and refuse to fax me the information then they claim they will only accept my payment over the phone.  

 

Not that I wish this on anyone, but I thought I was alone.  

 

Anyway, I have been summoned to appear in court, so wish me luck and the same to you.

Midland funding LLC is now taking me to court charging me more than the actual amount. I am so upset about the whole situation its been more than 6 or seven years old that I have actually owed this debt. I am a single mom mother of 5 and no money to pay this debt in court what should I do I am so confused.

If you want them to stop calling for a while, answer the pone, confirm that you are who they are trying to reach (that will provent them from calling again that day, even if you hang up right off). Then issue them a "Verbal Cease and Desist".  

They are then required to NOT contact you for 2 weeks.  

If you can record this conversation, all the better because if they do call you back during that time, they are in violation of the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809.

Thats illegal file charges against them. 

Either that or write them a letter telling them to stop calling. My message on my voicemail tells them to stop calling maybe that will work for you.

Maybe they are in the same boat as Bear Srearns. Sometimes too much greed will do that.
