Continued telephone harrassment despite written warning and acknowledgment

Starting calling in June 2014. Sent validation and cease and desist letter in July 2014. Received a letter from Midland stating that they had made a "mistake." Bozos started calling again yesterday and today. I sent another letter (and email - Midland has a online form to submit a validation request) along with a copy of their letter. I also have copies of my telephone records. I have no debt problems so am contacting an attorney. I think we all need to band together and file a class-action lawsuit. http://nypost.com/2014/09/16/court-announces-new-rules-for-debt-collection-agencies/ The state court system announced new rules Tuesday to stop debt collection agencies from using underhanded tactics to win judgments against poor or elderly credit card ​holders. ​ Shady ​debt collection agencies frequently score court judgments for the wrong amount of money or even from the wrong person by using incomplete proof or by pressing cases where the statute of limitations has expired, the state​’s court administrators​ ​said in announcing the reform. The collection agencies also frequently fail to tell debtors when a lawsuit was filed against them – a tactic k​​nown as “sewer service.” “While creditors have every right to collect what is legally owed to them, the Judiciary has an obligation to prevent inequitable debt collection practices in the courts,” said Chief Judge Jonathan Lippman, who called the new rules the biggest push for fairer debt collection in any court system in the nation. ​But the new rules,​ ​which go into effect Oct.​​1, 2014​ ​will require creditors to prove​ ​a​ ​debt is valid, disclose the debt’s chain of ownership, and show that the​ ​statute of limitations is still valid. Establishing the chain of ownership is important because third-party debt buyers purchase huge portfolios of delinquent debtors and then launch suits with critical documents missing, the court system said. Third-party debt buyers will have to file affidavits from the original creditor and all intervening creditors. ​And in a move aimed at addressing “sewer service,” creditors must give the court notice of any new lawsuits so the notice can be mailed to the debtor. If the notice is returned as undeliverable, no default judgment can be awarded. “The adoption by the Unified Court System of these rigorous new requirements will undoubtedly avert unwarranted default judgments in consumer debt cases and serve to protect the rights of all New Yorkers, including some of our most vulnerable citizens,​”​ Lippman said.​ There are over 100,000 credit card collection cases brought each year in state courts, according to the Unified Court System.

Was sued by Midland and Now they want to get paid

Went to court. They never showed. And now all of sudden they want to pay them. The case was dismissed. Now getting harassed all the time by them. They says I still owe 2 debts though them. I have papers for both. Never heard from them til now. I was in a class action lawsuit against them to. Now they want that money saying I owe that. Leave me alone MIDLAND. STOP HARASSING ME! The next step will me to sue them and see how they like it. I do have all the proof in the court records that are post in Brevard County Clerk of Courts, in Florida.

Midland Credit Management - Debt Review

Midland Credit Management buys old junk debt that the original company can't legally go after you for. They then call 24 hours a day, seven days a week, and attempt to get you to put a large deposit down with recurring auto payments. The total is higher than the original debt and does not remove the debt from your credit report. They also will often attempt legal proceeding threats to scare you into paying by them. Contest it and get it dropped based on the year limitations in your state.

Wow, I got this form letter from MCM which looked like a credit card company application. it was send using bulk mail.

Honestly, I question if this is even the real Midland Credit Management, Inc. Because the "original creditor" was someone I never borrowed money from...

The form letter says I am "pre-approved" to borrow money from them, basically to pay this non-existant debt. It's just really clever.

It seems like they are trolling. If I really owed this why not send me a real letter, not a bulk mail "debt" application.

I can envision calling them, and them asking me for information. It seems like any information I would give them, or even just the phone call could actually anchor me to the fake debt. It just makes no sense.

Doesn't even say what the original dept was for or how much. Only says current balance of $1123.79 and that I am pre approved for a 30% discount.

And they sent it to a business mailbox address, that I haven't hardly given anyone the address to, much less any ties to any personal creditors or debtors. So its just really suspicious. I don't even think this is mine.

I think they are trolling. I think they scammed up my name and address somewhere from the Internet, and seriously I haven't used any credit in over 6-7 years, I just pay cash for everything. Anyone get anything like this?

Its a total CLEVER direct mail campaign. Really wierd, and really super clever.

Even if you call them, its like..."oh, we've got a live one on the the line... Let's see if we can get them to validate anything, that will help us tie them to this debt..."

Lowlife *** sucking bottom feeding *** are trying to collect on old debts, real or imagined, that they bought for 2 cents on a dollar from the original creditor. In most cases, these are fraudule

Called 21 times between 8/13/14 and 8/25/14 with increasing frequency, sometimes as often as 5 times a day. I'm a retired American Vietnam Era Veteran with some mobility issues. My wife is still working so I have taken over the household chores such as cleaning, laundry. It's a real pain in the *** to have to go to the phone when I'm doing something only to find that it's these vermin. I finally called these *** on 8/25 to inquire why they where calling me. I spoke to a woman with barely intelligible English and she referred my to a man with equally unintelligible English who asked for my name. I said that he had my phone number and why did he need my name. He said to ensure he was speaking to the right person. I refused to give him my name and he said that my number would be removed from the list. They called two more times that night, 8/25 and haven't called since (8/28). I don't know if this is a real fix, but so far, it has worked. I hope this may help some of the tortured souls that have victimized by these ***

Midland Credit Management - Debt Collection Review

I received a call this morning from MCM in regards to a debt they claimed I owed and they bought my account in May of this year. I asked if they could send me something regarding this info so I can look into it. The CSR stated they already mailed out a letter so when I inquired about the address, they gave me an address I have never like bed at nor ever heard of. He also gave me a list of phone numbers that were not mine. Is there anyone I can speak with to find out what is going on? This is "fishy"

read it. draft a complaint for your local superior court. Send it to them along with a demand letter and a proposed settlement 9ask for between $1200 and $2,500, depending on what violations you find.

You have one year to file.

You did the right thing. CSR is probably not being truthful, but it does not matter.

The proof of debt needs to be in your hands to be valid.

The issue is theirs to deal with, not yours.

Had dealing with this company...had a debt that was owed..paid 100.00/month for 12 months debt was charged off..this was 2012 now the IRS says we owe them money back because midland management filed with the IRS but we were never sent a 1040c when we filed our 2012 taxes..shame on you Midland thats poor business practices..if I knew how to report you to the Better Business Bureau I certainly would...any help would be appreciatied

I never called them cause I knew I didn't owe anything haven't heard from these fools in 6 years...

Back in 2009 I settled on my credit card for 9000 been so long I don';t have any records showing I had settled, now this place is bugging me after 6 years, wanted me to make 300.00 payments then we got it down to 50.00 but why should I pay,its already been settled,but no prove.....Why haven't they contacted me before now,6 years have gone by...Don't know what to do..

People are rude ,can't speak English,hard to get thru to on the phone , they weren't suppose to deposit a check until a certain day and then told me that they sent out to a third party to process so who knows who is seeing your personal info . This company needs to be reviewed by the attorney general on their business practices .

Sends bills to nursing home

Midland Credit Management has sent a collection letter to my mother in a nursing home claiming that she owes money to a department store. My mother has a degenerative brain disease and has not been able to go shopping by herself for at least 10 years. This is the first I have seen of any debt. I am her primary caretaker and power of attorney. I called to see when the debt was incurred, but they tell me it is private data. Shame on those sleazy bastards.....really....scamming an 88 year old in a locked dementia unit.....what next???? Perhaps they would like the address of her cemetery plot so they can be sure to follow her there.

I got a cell phone almost 5 years ago. Almost right away I started get collection calls from Midland for a Kathy Williams or Williamson.

I don't know this person and have no relationship to them financial or otherwise. They said they would remove the number from their records but 6 or 8 months later they call again. Why don't I just get another number? Because this is my number and I have done nothing wrong.

The next time they call me, I'm gong to get a lawyer and have him crawl so far up their butt he can tell me what they had for breakfast. If all they have is some ones old phone number as a lead they must be a pretty *** poor outfit.

I overpaid Midland Credit Management and they owe me $$$$$!!!!

I am owed money ($425) from Midland Credit Management from over payment and I keep getting a run around after repeated phone calls. They wouldn't let me speak to a manager. I keep being told that they're "looking into it," but I still haven't gotten my over payment check after two months. If I owed Midland Credit Management money (as I did), they'd be sure they got it from me from harassing calls and mail!! I think that after I spent 5 months over paying this company that I should get the same compliance. Total BS! I am owed this money!!!!!
